Attorney Mooradian recently secured special findings of fact and rulings of law for an immigrant juvenile from the Worcester Probate and Family Court. The order of special findings indicates that the juvenile is under 21, has been neglected, abused and abandoned by her parents, and that it is in her best interests to remain in the United States versus return to her country of origin.
A recent Massachusetts law expanded the class of individuals who the court may classify as “immigrant children.” Attorney Mooradian argued to the court that it had jurisdiction pursuant to this law. The judge agreed and granted a predicate order containing protective findings. Now, Attorney Mooradian can use this probate court order to seek benefits with the USCIS Lawrence Field Office, as well as indicate to the immigration court that the client is in the process of seeking benefits. By moving forward with this special immigrant juvenile process, Attorney Mooradian can remove he immediate risk of deportation for this client.
