Case Terminated after VAWA Prima Facie Determination

Attorney Mooradian recently secured the dismissal of removal proceedings before EOIR via a joint motion based on a VAWA prima facie determination.  Mooradian submitted a request under prosecutorial discretion for a woman who had suffered abuse at the hands of a U.S. Citizen spouse.  USCIS had already determined that the woman is prima facie eligible for relief under the Violence Against Women Act.  Since that time, Mooradian submitted evidence of the abuse and USCIS's prima facie determination, resulting in a joint motion to dismiss EOIR's removal proceedings against the Respondent.
