Green Card for Client from Asia

Attorney Mooradian recently received lawful permanent residence for a client from Asia.  His client had been in the United States for many years working pursuant to a J1 visa.  The case presented questions about whether a J1 visa waiver might be needed, though ultimately no waiver was required and Mooradian advised the client to forego the waiver process.  

However, the client had engaged in unauthorized employment.  Mooradian advised the client to present the information honestly to the interviewing officer, including indicating a violation of her nonimmigrant status on the adjustment application itself.  Because of the particular circumstances of this case, Mooradian explained, the client was exempt from the ground of inadmissibility relating to both visa overstays and unauthorized employment.

Following a brief interview at the USCIS office in Lawrence, MA, the client was approved for lawful permanent residence.  She will now be able to remain in the United States with her U.S. Citizen spouse.
